南韓SM娛樂公司對JYJ組合的圍追堵截進一步升級,繼在向法院申請JYJ專輯禁售令後不久,SM公司又聯繫了負責JYJ專輯銷售的南韓華納公司的美國母公司,試圖在全球封殺該專輯。

SM公司在本月8日向法院提出申請,稱金在中等三人與SM公司的法律糾紛還沒有進行最終判決,因此金在中等人與其他經紀公司簽約發售唱片涉嫌雙重契約,為避免產生新的法律糾紛,應立即禁止這張專輯的發售。因為JYJ這張專輯是在世界範圍內發售,因此SM公司在向法院申請了國內禁售令以後,又向負責這張唱片流通的南韓華納的美國母公司發去通知告知了這一情況。

對於SM公司這一舉動,招致了JYJ的經紀公司以及南韓華納的不滿,不過南韓大眾文化藝術產業總聯合會卻站在了SM公司這邊,要求韓國各大電視臺和電臺集體封殺JYJ,實際上從12日開始南韓各大電視臺上都已經看不到JYJ的身影。

Recently, we reported that SM Entertainment (SME) filed for a provisional ban on the sale of JYJ’s album ‘The Beginning‘, as well as an exclusive contract suspension injunction between JYJ and their alleged contracted company, CJes Entertainment. Following this, the Korean Federation of Pop Culture and Art Industry (KFPCAI) sent out letters to broadcasting companies and various online album distribution sites, prohibiting JYJ from making appearances on shows and halt album sales.

SME accused that Kim Jaejoong, Park Yoochun, and Kim Junsu signed a contract with another company despite their exclusive contract with SME still in effect. Even though JYJ has made progress to end the injunction, it would be illegal to sign with another company because of their exclusive contract with SME.

However, a representative from JYJ’s side expressed,
‘JYJ members doesn’t have a exclusive contract with CJes Entertainment like SME or KFPCAI has claimed. CJes is simply a management / mediary that takes care of JYJ’s activities and public relations work in Korea.‘
Furthermore, JYJ’s spokesperson Prain (프레인) expressed in a phone interview with reporters,
‘JYJ did not sign a formal contract with CJes. CJes is merely an agency for JYJ. CJes handles management related work, just like how we handle publicity related work, and Warner Music handles the album related work. A misunderstanding must have occurred because ‘agency’ is still an unfamiliar term in Korea. After the oversea showcases are finished, we will reveal sufficient documents and evidence.‘
With regards to SME’s claim that JYJ’s independent activities are problematic, JYJ’s spokesperson answered,
‘This is something that has reviewed by the legal system. By law, there is no problem for JYJ’s activities. We have confirmed that SME has no reasons to file an album sale prohibition injunction against JYJ.‘
So it seems that they’re trying to infer that JYJ hired CJes as a management agency instead of the assumption that JYJ is working under the CJes label.


JYJ’s ‘The Beginning’ has sold over 520,000 albums in pre-order sales

It was recently reported that the trio JYJ have already received 520,000 album pre-orders for their new album, ‘The Beginning’.

On October 14th, JYJ’s album distributors, Warner Music Korea, revealed,
“Out of the limited number of 99,999 special albums we produced, we have received over 300,000 pre-orders for their special album, and 220,000 for their regular album. Because of this, it has been taking some time trying to coordinate the demand and supply to various stores. Today will be the first time the album will be on sale for the fans, while the special album will be released later on the [October] 18th.”
Warner Music Korea expressed,
“With 520,000 albums sold just through pre-orders, JYJ’s ‘The Beginning’ has so far become the best sold album this year, and many are expecting this to revitalize the depression of album sales.”
Lastly, they added,
“We were able to feel the explosive interest from fans, after receiving three times more album pre-orders for their special album than the original quantity we produced. We will soon be exploring more ways for purchasing their special album, especially for those fans who have not been able to get hold of them.”


KFPCAI send out official letters of request to broadcasting stations to prevent JYJ’s TV promotions

JYJ與前經紀公司SM的官司尚未解決,SM向法院要求禁止該專輯銷售,連南韓大眾文化藝術聯合總會,也要求當地所有電視台、電台、唱片公司及音樂網站封殺他們。

由演藝製作者協會、音樂劇協會及經理人協會等組織共組的南韓大眾文化藝術聯合總會,發言人指出JYJ的合約糾紛仍未解決,就與其他公司簽約及公開演出,創下極壞先例,擔心招來惡果,必須禁止他們活動,直至官司解決為止,這項舉動又讓JYJ出道受阻。

Following news of SM Entertainment filing a provisional ban on JYJ’s first new album, ‘The Beginning‘, as well as filing an exclusive contract suspension injunction between JYJ and their contracted company, CJ Entertainment, it was also confirmed that on October 11th, official letters of request were sent to three public broadcasting stations (MBC, SBS, KBS), one cable broadcasting station (Mnet), and various online album distribution sites to refrain JYJ from making appearances on shows and halt album sales.

On October 12th, a fan of JYJ wrote on an internet open board,
“I work at a cable broadcasting station, and I heard that the ‘Korean Federation of Pop Culture and Art Industry (KFPCAI)‘ sent out official letters to both the public and cable broadcasting stations.”
According to this fan, the official letter of request contained information stating that as JYJ may harm the effect of Korea’s Hallyu Wave, they state they will not be responsible for any disadvantages caused by their appearances on their shows.

This information was later directly confirmed by an associate of the KFPCAI, and has since been spreading at lightning speed on Twitter and various internet communities, currently causing a great deal of concern amongst JYJ’s fans.

A representative from the ‘Korean Entertainment Producers Association’, which is one of eight major associations in the KFPCAI, explained,
“We are not siding with SM Entertainment, but we are aware of JYJ currently holding onto a dual contract. This situation has risen because their exclusive contract problem with SM Entertainment has not yet fully been resolved by the law.”

The representative continued,
“Whether it was the company that mistreated the group, or the group created the problem, we do not know. That is a separate issue in itself. However if we let this ‘dual contract’ issue pass, what agency would even want to raise their artists?”
 He stated they are not sure when exactly the group decided to separate from the company and walk their own path, however they are merely just speaking opinions on behalf of the industry.

He added,
“DBSK had a huge effect on the Hallyu Wave and on other idol groups walking their own paths, but for the group to separate is the same as throwing cold water on the numerous agencies preparing hard to advance overseas.”

The representative also explained that the group's separation has the potential to damage the reputation of the idol groups who have already successfully advanced into the Japan market.

In addition, through JYJ's album distributors, Warner Bros, KFPCAI will also be sending out requests to postpone album sales on music sites such as Melon and Dosirak.

Prain, who are JYJ's PR agency, revealed on October 13th,
“They have been so busy all of yesterday and today with their showcase that they have not been able to look into the official letters that were sent out. However they don’t believe it is something to worry too much about.”
With regards to SM’s provisional ban request against their new album, Prain said,
“We are still currently trying to understand the exact information details on that matter. We will be exchanging discussions with the group’s management company, CJ Entertainment, later this evening.”
