Kid Rock & AC/DC Rank 3,4 In 2008 Despite Anti-Digital Stance

Kid_rock_3Nielsen SoundScan reports show that Kid Rock's "Rock N Roll Jesus" was the third best selling album of the year in the U.S. as of the beginning of December.

The release was CD only until nearly a year after its release, when Rhapsody grabbed exclusive digital rights where its sold only 3,000 digital copies so far.
Acdc_logoAC/DC has still not gone digital with its "Black Ice" which was released exclusively via Wal-Mart. But it is the fourth best selling album of the year with 1.6 million copies sold.
While digital sales unequivocally contributed to the success of many of the records that top the 2008 charts, these two release prove that in a shifting marketplace there is no single path to sales success.

UPDATED: Sadly 'tis the season...

  • Long rumored layoffs at Epic Records have begun...(Billboard)
  • In May of 2007 CBS bought bought Last.fm for $280 million. Yesterday they layed off 20 members of its 95 person staff calling the move further "integration".
  • Deep staff cuts continue at independent distributor/one stop Alliance Entertainment. Sources have it's Innovative Distribution Network shutting down entirely leaving a number of indies homeless. Parent company Source Interlink hinted at further trouble during an earnings call yesterday and the company's stock hovered around 20 cents a share.

Bopaboo Used MP3 Store Walks Legal Tightrope

Bopaboo and concluded that the most obvious illegal act happened when the track was copied and bopaboo did not do the copying. But "is there a way to confirm that the files being sold are obtained legally and that the seller is not retaining copies?," he wrote on Idolator.

"If not, is a company truly able to insulate itself from liability through its terms of use, and are consumers willing to take the risk?" In other words, just like a pawn shop can be prosecuted for selling goods it could reasonably have suspected were stolen, bopaboo might be proven to be facilitate and even encourage the sale of illegally copied tracks and the buyer to have purchased stolen or copied goods. Bopaboo is not unaware of the legal challenges it is certain to face.

"When we began Bopaboo, we set for ourselves not a modest challenge: can we provide consumers a legal method and marketplace to buy and sell digital music?," executive Alex Meshkin wrote on the company's official blog. The next chapter's should be interesting.

2008-12-10_012029bopaboo這家正在邀請內測的音樂網站試圖創造一種新的線上音樂模式–二手數位音樂商店模式,idea上與Lala.com初創時的二手CD交換模式有雷同之處。其目的是説明消費者把過剩並且已經成為累贅的無DRM保護的數位音樂低價轉售給其他使用者,隨著數位音樂消費趨勢的增長,這樣的需求顯然是存在的。

但是網站聲稱用戶銷售的歌曲必須是合法購得的,這點恐怕難以鑒別。即使能證明用戶轉售的歌曲是合法購得的,也無法確保用戶沒有保留備份。也就是無法保障其版權的合法性。另一方面網站暫定的價格為0.25美元/首起,在現在數位音樂零售打價格戰的階段,這個價格也並不誘人。在Amazon的mp3商店特價區裡,Coldplay的專輯“Viva La Vida”(256kbps)也僅買5美元,甚至還有不少1美元以下的。我有些懷疑bopaboo這個服務模式能堅持多久。



EMI And WMG Expand Distribution Partnership 擴展區域經銷的合作夥伴關係

Will Partnership Extend To U.S.?

Emi_2 Under an expanded agreement, EMI will add digital distribution to physical sales of Warner Music Group repertoire in India and the Middle East, a role it has held since 2005. Turkey has also been added to partnership. In tueb, WMG markets and distributes EMI in Hong Kong, Indonesia, Malaysia, Singapore, Korea and Thailand. Both label groups maintain their own direct A&R and promotional presence in all markets.

Wmg_2EMI is openly exploring farming out it's North American brick and mortar distribution to a third party. The expanding relationship between the worlds 3rd and 4th largest label groups would point to WMG as the frontrunner.

In one or more of these countries, EMI is also the exclusive local distributor of several independent labels including Domino, Beggars Banquet, Ministry of Sound and Cooking Vinyl. EMI also distributes Disney’s soundtrack and Hollywood repertoire in the Middle East and Turkey.

Adrian Cheesley, EMI Music’s President - International, says: “These markets have exciting growth potential, especially in digital. We are delighted to be extending our successful relationship with Warner Music to include digital rights to their fantastic artist roster and catalog and to cover Turkey as well.”

John Reid, Vice Chairman, Warner Music International, says: “With us currently serving as EMI’s distributor in South East Asia, and with EMI serving as our distributor in India, the Middle East and Turkey, we have developed a strong partnership that we’re pleased to be expanding with this deal. 誰在贊助音樂?

廣告支援的各種數位音樂服務、名目繁多的的音樂節….事實上都是體現了品牌商贊助音樂模式的成長。中國今年即便是受了奧運會的影響音樂節仍是比往年多了不少,據聞明年的音樂節更將會在各地城市開花。至於這花是否能開得長久,除了音樂消費者是否賣帳外,關鍵也還得看品牌商的支持了。

英國一位研究者在英國做了個調查,讓一些年輕人在6分鐘內寫出積極參與有利於音樂相關事項的品牌。結果發現65%的調查者認為無線運營商O2與音樂最為密切,45%認為是無線運營商Virgin,35%認為是啤酒品牌Carling。的確這三大品牌商在音樂活動支援方面相當活躍,它們甚至有自己主辦的音樂節,O2有O2 Wireless Festival、Virgin有V Festival,Carling有Reading Festival

唱片公司正在喪失議價能力

近日傳聞iTunes音樂商店與除EMI以外的另三大唱片公司談判取消DRM遇到一系列問題:其中華納要求歌曲單價能做調整,部分熱門單曲可以設定高於0.99美元的單價;Sony&BMG要求iTunes採用代理模式,能讓他們有完全自主的控制權,而iTunes則只是代理分發給消費者;環球則要求在歌曲上增加數字浮水印。三大唱片公司均要求iTunes先接受他們的這些條件,再行商談DRM取消問題。

我認為在歌曲單價方面,iTunes在iPhone的Application銷售上採用開發者自行定價的模式,也開始嘗試與一些歌手/唱片公司合作發佈歌手的應用程式,可以稱得上真正的數位化音樂專輯。所以未來iTunes可能更希望唱片公司為歌手推出這種數位化音樂專輯去自行調整價格,而不是去改變目前的單曲價格體系。

代理模式顯然沒太大可能性。浮水印倒是有可能被採納,之前iTunes銷售的無DRM歌曲檔中也嵌有使用者的帳號資訊,只是對於使用者來說是否會認為觸及隱私以及會否造成負面影響就不好說了。這事也反映了唱片公司在數位音樂的變革階段失去的不僅僅是高額的唱片收入回報,更可怕的是他們正在喪失他們的議價能力。這主要也跟數位音樂的市場格局有關,在互聯網音樂市場,iTunes以近20億的年單曲銷量壟斷著市場,無線音樂市場的電信運營商們雖然沒那麼強勢,也都不是省油的燈。

至於中國,在數位音樂商店剛起步的階段,唱片公司提出的要求不僅僅是高額的版權保底費用,還嚴格控制數字音樂商店的歌曲售價。而現在面對佔據著70%以上數位音樂市場的中國移動,唱片公司幾乎完全喪失了議價的能力,唯有依循中移動的遊戲規則。唱片公司目前也唯有通過扶植一些企業,去改變目前的市場格局,爭得更多的控制權。Amazon的數位音樂商店當屬於此列,只不過要改變也不是短期可以實現的。
